WHAT NOTICE CAN I SERVE ON MY TENANT?

HERE ARE THE MOST COMMON NOTICES TO TERMINATE TENANCY

THREE DAY NOTICE TO PAY RENT OR QUIT

If there is an oral or written agreement to pay rent, and the tenant is not paying the rent pursuant to that agreement, you can serve this notice giving them 3 days to either pay the past due rent or vacate the premises.

THREE DAY NOTICE TO PERFORM OR QUIT

If the tenant is violating one of the terms of the lease, either by doing something that is prohibited or by not doing something that is required, you can serve this notice giving them 3 days to stop violating the lease or vacate the premises.

THREE DAY NOTICE TO QUIT

This is a more serious notice that says that tenant’s violation of the lease was more sever and tenant doesn’t get 3 days to perform. Under this notice, tenant has 3 days to vacate the premises, period.  This is usually used when tenant is a legal nuisance or where tenant has been using the property for an illegal purpose. This notice might require a police report to prove the nuisance or illegal purpose.

THIRTY (30) DAY NOTICE TO QUIT

If your tenant is paying the rent and complying with the lease but you want to terminate their tenancy for some other reason, and they have only been living in the property for less than one year, then you can serve the tenant with a 30 Day Notice to Quit which terminates their tenancy in 30 days.  This is a ‘no-fault’ notice.

This notice does not apply if tenant has a lease, and/or where the premises are under rent control.

SIXTY (60) DAY NOTICE TO QUIT

If the tenant has been living in the property for a year or more then you have to serve them with a 60 Day Notice to Quit to terminate their tenancy in 60 days.  This is also a ‘no-fault’ notice.

This notice does not apply if tenant has a lease, and/or where the premises are under rent control.

 

3/60 DAY NOTICE TO QUIT AFTER FORECLOSURE

If the property was bought in foreclosure and the former owner still remains in the property, you can serve them with a 3 Day Notice to Quit After Foreclosure. But if the parties residing in the premises are tenants of the former owner, then they get a 60 Day Notice to Quit After Foreclosure. It is best to put them both on one notice as a 3/60 Day Notice so they’re both served at same time.

3 DAY NOTICE TO QUIT AFTER VOLUNTARY SALE

If you buy the property from an individual seller and they refuse to vacate at the close of escrow or at the end of any agreed upon time, you can serve this notice requiring them to vacate within 3 days.

EVICTIONS THAT DON’T REQUIRE ANY NOTICE TO TENANT

  1. If the lease expires on a certain date, and the tenant does not vacate the premises by that date, then you can go straight to filing your eviction without giving tenant any prior notice. (Unless you accept any rent money from the tenant for after the expiration of the lease, which creates a brand new month to month tenancy.)
  1. If the tenant puts a move out date in writing to the landlord, and does not vacate the premises by that date, then you can go straight to eviction without giving tenant any other notice. Note – Once tenant puts it in writing they cannot take it back unless the landlord agrees to let them take it back.
